Welcome to Tootles Adventures website. These terms and conditions apply to the Site and all of its divisions, subsidiaries and affiliate operated internet sites which reference these Terms and Conditions.
Tootles is a platform dedicated and specialised for the tourism industry. It aims to bring together tourism services providers and patients/clients thereby providing an audience for advertising and marketing initiatives.
The key in marketing and advertising is making impressions at the right moment and Tootles platform offers opportunities to advertisers in Tourism industry. Tootles only displays tourism related advertisement through its Tootles mobile applications and Website.

Acceptance of These Terms

BY AGREEING TO PLACE ADVERTS OR USING ANY OF OUR MARKETING SERVICES PROVIDED BY US DIRECTLY OR OUR PARTNERS VIA THIS PLATFORM YOU AGREE TO ABIDE BY THESE BUSINESS TERMS AND CONDITIONS. YOU ALSO CONSENT TO PAY THE FULL COSTS ASSOCIATED WITH THE MARKETING PLAN YOU HAVE CHOSEN.

Use of the Site for business

You are 18 years of age.
We grant you a non-transferable and revocable license to use the Site, under the Terms and Conditions described, for the purpose of advertising personal tourism services, products and other issues related to tourism service provision on the Site.

Campfire Chat Advertising

Tootles offers advertising opportunities to advertisers wishing to target the public at large through the website. Tourism service providers and the public visit the Tootles website Homepage creating an audience to target both the public and tourism services providers. This Campfire Chat is a “silent” timeline, meaning members can’t post messages. They are meant only for our daily tourism and business updates.

Through its platform, Tootles can create and publish your tourism related events to assist you get the desired outreach. The creation or updating of events sends mobile and email notifications to all the public and tourism services providers signed up to the platform.

Vacancies Advertising

All tourism services personnel and providers can post their vacancies for a fee on the Tootles platform. We appreciate the importance of matching the right personnel with the right employer in service industries and created this feature to help you will your recruitment.

Real Estate Advertising

Tootles will place adverts for those tourism service providers looking to for premises to rent, those leasing business premises, those with business premises for sale and those looking for business premises to purchase.

Business Opportunity Advertising

Tootles will accept adverts for those businesses or individuals looking for investment opportunities into their businesses or businesses of others or business partnerships.

Advertising Formats

Text Advertising

We will send your text advert to all our subscribers once with a maximum number of 200 words.

Picture Advertising

Standalone: We will send your picture advert to all our subscribers once.

With Text: We will send your picture Advert with text to all our subscribers once. You can also add up to 60 words and send them together with the picture.

Video Advertising

We will send your video advert link to all our subscribers once. You can also add up to 60 words and send them together with the video.

User Submissions
Anything that you submit to the Site and/or provide to us, including but not limited to questions, reviews, comments and suggestions will become our sole and exclusive property and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment or other content. No hate speech, pornography, politics, foul language, derogatory, racist, tribalistic or sexist comments are allowed on this Site.
You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.

Termination
In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions or revoke any or all of your rights granted under the Terms and Conditions. Upon the termination of the Terms and Conditions, we shall, in addition to any other legal or equitable remedies, immediately revoke the password and account identification issued to you and deny your access to and use of the Site in whole or in part. Any termination of the Terms and Conditions shall not affect the respective rights and obligations (including without limitation payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination. If you are dissatisfied with the Site or with any terms, conditions, rules, policies, guidelines or practices of business to customer (B2C) Services in operating the Site, your sole and exclusive remedy is to discontinue using the Site.

To improve customer service. Your information helps us to more effectively respond to your customer service requests and support needs.
To personalize user experience. We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site.

Online Transactions
Tootles or their partners may refuse to process a transaction via Tootles Pay Services if it is reasonably believed that by doing so;
An applicable law, code or any other legal obligation or duty applicable to us may be broken or contravened or;
It may be exposed to action from any government regulator, or;
It may be linked with fraudulent or illegal activity.
All online money transactions will be reported in accordance with prevailing laws and regulations in force in Zimbabwe or country of operation and other international laws applicable.

Sharing Your Personal Information

We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We may share your information with these third parties for those limited purposes provided that you have given us your permission.

Arbitration
Any disputes, controversies or differences arising out of the implementation, interpretation, performance of these Terms and Conditions, shall be finally settled through arbitration by a single arbitrator to be appointed in accordance with the rules of Arbitration. The arbitrator shall be a person who is legally trained and who has experience in the information technology field and is independent of either party. The venue of the arbitration shall be Harare or any convenient location. The language used in the arbitration proceedings shall be English. The award of the arbitrator shall be final and binding and may be entered in any court of competent jurisdiction and enforced in accordance with the Arbitration laws of Zimbabwe or other international arbitration laws applicable. Notwithstanding the foregoing, the Site reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through competent courts.

Trademarks and Copyrights
All intellectual property rights, whether registered or unregistered, on the Site, information content on the Site and all the website design, including but not limited to text, graphics, software, photos, video, music, sound, their selection and arrangement, all software compilations, underlying source code and software shall remain our property. The entire contents of the Site are protected by copyright as a collective work under Zimbabwean copyright laws and international conventions. All rights are reserved.

Applicable Law
These Terms and Conditions shall be interpreted and governed by the laws in force in Zimbabwe or country of operation and other international laws applicable.

Tootles reserves the right to change, modify, add or remove these Terms and Conditions at any time. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions regularly for updates.
Prices, rates and tariffs are subject to change without notice and will be effective immediately when posted on the site with no other notice provided. Please check regularly or before any transaction to see current prices, rates and tariffs.
Your continued use of the Site following the posting of changes to these Terms and Conditions, tariffs, rates and prices constitutes your acceptance of those changes.

Online Payment Services

We charge for online bill payment by individuals to service providers and transactions between businesses. We charge for example 2% platform levy to be shared equally between the parties involved in the transaction.
